Bei einem Diebstahl (oder Raub, entspricht Wegnahme mit Gewalt) handelt es sich ebenso um einen Totalverlust. Für die Abwicklung der Schadenregulierung gelten jedoch einige Besonderheiten.
A.2.14.3 Ist das Fahrzeug entwendet worden, ist zunächst abzuwarten, ob es wieder aufgefunden wird. Aus diesem Grunde zahlen wir die Entschädigung frühestens nach Ablauf eines Monats nach Eingang der schriftlichen Schadenanzeige.
Taucht das Fahrzeug innerhalb der Wartefrist von einem Monat wieder auf, ist der Versicherungsnehmer verpflichtet, sein Fahrzeug wieder in Besitz zu nehmen. Wird das Fahrzeug in einem Radius von 50 Kilometern ausgehend vom ständigen Wohnsitz des Versicherungsnehmers aufgefunden, muss dieser die Kosten der Rückholung selbst tragen. Liegt der Fundort jedoch mehr als 50 Kilometer entfernt, erstattet der Versicherer die Kosten für ein Bahnticket bis zu einer Höchstentfernung von 1500 Kilometern zum Fundort.
Die alte Kürzungsregel in Höhe von 10% in den Fällen, in denen eine elektronische Wegfahrsperre nicht verbaut war, ist heute nur noch bei entsprechend alten Fahrzeugen von Bedeutung, die dann aber entweder aus wirtschaftlichen Gründen nicht (mehr) über eine Kaskoversicherung verfügen oder aber ohnehin über eine Sonderabsicherung etwa in Form einer Oldtimerversicherung verfügen, innerhalb deren Versicherungsbedingungen diese Kürzungsklausel nach unseren Erfahrungen nicht enthalten ist. Unseres Erachtens kommt die Kürzungsregel daher lediglich noch im Bereich der sog. Youngtimer in Betracht, bei höherwertigen Fahrzeugen kann dies durchaus ärgerlich sein. Individualabreden mit der Versicherungsgesellschaft sind aber möglich (Verzicht auf die Anwendung der Kürzungsregel, ausdrücklich schriftlich vereinbaren!)
Wird ein entwendetes Fahrzeug erst nach Ablauf der Monatsfrist aufgefunden, geht es automatisch in das Eigentum des Kaskoversicherers über.
